Clark State Forest - Indiana Jewel In The South


Clark State Forest is located on US 31 about one mile north of Henryville, Indiana and about ten miles south of Scottsburg, Indiana. This is Indiana?s oldest State Forest, established in 1903. It is also one of the prettiest of the State Forests.

Clark is very hilly, and the narrow, one lane asphalt system of roads which wind their way through the Forest makes a very scenic drive, especially in the autumn when the leaves are turning. There are eight sheltered picnic areas, the nicest ones overlooking Franke Lake. There is Old Franke, probably the best one, and New Franke, on the southwest side of the lake.

Clark State Forest, like all Indiana State Forests, is a mixed use facility. Hunting and fishing is permitted on the property. There is a popular gun range near Bowen Lake on the west end of the Forest. The State Of Indiana also sells timber from the Forest. Sales from the State Forest provide funds which help administer the State Forest system.

There are about one hundred miles of horse trails here, as well as six parking lots for day users. Horse riding among the wooded hills of Clark State Forest is a popular activity and the weekends will find a lot of horse riders on the trails.

The Forest boasts a forty five site primitive camp ground. There are seven public lakes ranging in size from thirteen acres to two acres. Franke Lake, at thirteen acres, is on the southeast side of Clark, the main road winding past it and its two picnic areas. Fishing is permitted, with an Indiana Fishing License in any of these lakes.

This road then climbs a rather impressive hill up to the fire tower. On the left, just before the fire tower is a picnic area with a very impressive view. On a clear day, the skyline of Louisville, Kentucky, twenty miles to the south can be visible against a background of trees and sky. There are two unmarked trails here. One, descending down the hill to west of the picnic shelter, is a one quarter mile loop which affords some nice views in the fall and winter when the leaves are down. Another trail, little used, leads down the hill. A hike on this one is not for the unprepared. It is steep, slippery, and finally dies away in the forest. A return up the hill is then necessary. This is a very pretty trail with some nice views, but not for the inexperienced hiker.

The fire tower is the next item of interest on this road. Ninety eight steps to the top, the tower is about one hundred feet tall. Unlike most fire towers, access to the lookout is permitted. An unfettered look at the surrounding countryside here makes it well worth the climb up. Again, Louisville is visible to the south, as well as some Indiana villages in other directions.

You can complete the loop around the Forest by turning right at the satellite dish antennae, right again on Bloomington Trail. This leads back to US 31. Maps are available at the State Forest Office, which is just off US 31, the entrance about a quarter mile north of the entrance to Clark State Forest.

There are only two marked hiking trails at Clark, the .9 White Oak Trail, trailhead on the right before the turnoff to Old Franke. The Forest Resource Trail, a one mile loop, is located near the main entrance. The trail head is near the Pine Lake picnic area.

Clark State Forest features a diversity of activities for the nature lover. Hiking, fishing, picnicking, hunting and horseback riding are all activities which can be pursued here. Add to that a scenic drive which encircles the facility, you have the ingredients for a fun day outdoors.

The Indian economic bubble has managed to achieve a commendable feat of growing bigger and bigger without bursting. The consequences are there for all to see. Indian Real Estate: Special Property Zone



After a brief lull, the realty sector is once again in an uproar! Initially, Chandigarh and its periphery were the best investment options, however, skyrocketing property prices in the area has investors looking, further beyond the Silver City. No longer, do they mind going as far as Ambala for the purpose of investment, as the city is fast emerging as Haryana's business and development hub.


After Lalru, Derabassi and adjoining villages, now it is the turn of Ambala to leave its mark on the map of Indian real estate. According to experts, there have been gradual ups and downs in property prices, but it's a hot realty scenario now.

Then too, Mohali's Fashion Technology Park has roped in Ambala based artisans, and as the floating population increases, many employees are bound to make the area their home base. Ambala, as it turns out is the best deal in terms of realty, and with the state's firm desire to develop the area, property rates will only continue to increase.


Meanwhile, investors are making a beeline to invest for lucrative returns, with many inquiring about property rates. Rates might be stable right now, but one never knows when they might spin upwards, says a property consultant. Tripathi, an investor consultant predicts the completion of Rajiv Gandhi Chandigarh Technology Park (RGCTP) will be one of the biggest IT specific SEZ Park in the country. And, after its completion, Chandigarh property prices will increase, going beyond the average person's reach. Real estate agents are anticipating a rise in the housing demand for IT employees, who are sure to move here from the hi-tech cities of Bangalore, Hyderabad, etc.


Today, with distances no longer an issue, it is why Ambala for property investment. The other development on the cards is the Zirakpur - Derabassi belt, which is also providing a thrust to property prices. Mid-point the distance is the same, if covered from either Chandigarh or Ambala. Indian Teepee


As I was driving to work, I noticed a neatly stacked pile of tree limbs. I thought for a moment....what could I do with that? As a school teacher at that time...I loved creating, using found things.


I decided that maybe I could make a Teepee and went to work...creating the focal point to a beginning of a nature center. I gathered some of the taller, straighter limbs with a robe ...securing it tightly at tone end. I spreaded it to the size that I wanted and with smaller limbs...I secured the circumference. I layered the exterior with muslin material....painting Indian symbols on the outside. A nice fleece blanket was added for the door and a fur rug...made it extra cozy for the children.


It was a place where the children could go and read ... or play, as we called it, The quiet room. As many as 5-6 children could easily go inside....and so could I. : )

The Food Processing Industry: India's next growth sector



The food processing industry is badly in need of infrastructure and the government is offering several incentives and tax breaks for foreign investment. Currently, 100% FDI is permitted in the food processing sector and the Union Government is likely to allow 51% FDI in food retailing, covering the sectors of dairy, marine, poultry, fruits and vegetables by end 2006, it is estimated.


According to the McKinsey FAIDA report, India produces 146 million tonnes of fruit and vegetables, second only to China. The Associated Chambers of Commerce and Industry of India (ASSOCHAM) estimates that the food processing industry, which is currently worth USD 325.4 billion, is likely to grow at 8% per year till 2007 and 10% per year by 2010. It is estimated that USD 108.4 billion was annually lost to wastage due to outdated technology, gaps in the distribution chain and widespread use of commission agents.


Only 6% of fruit and vegetable production in India is currently processed while the target is 20%. To increase the country's share in the global market to 3% from its current 1%, the government is opening the industry to international companies to improve infrastructure, cold storages, packing and transportation.


It was due to this lack of an efficient supply chain as well as a continuous cold chain that India's first international food retailer, Nanz which was backed by Delhi-based Escorts Group, US-based Marsh Supermarket and Nanz AG from Germany went out of business.


An empowered group of ministers have already given the go-ahead to the proposal of FDI in food retailing. This move will allow foreign investment in food retailing, grant infrastructure status to the food processing industry, access to priority sector lending and reform taxation laws.


The main push behind opening up the agri-business sector is to reduce wastage, which amounts Rs. 50,000 crores annually. Minister for Food Processing Subodh Kant Sahai said that the food-processing and agri-business industries should get an "infrastructure category" status that has been given to airports, to attract investment to set up cold chains and other supply chain components.

The continuing fare tussle between the Railways and the Low-cost airlines has changed the contemporary scenario for the Indian traveller. A ticket on India's low-cost carrier (LCC) has made flying, once confined to the rich and elite, an affordable reality for the hordes of Indians travelling across the country.


It has taken some time for the low-cost airline industry to carve a niche for themselves, but the wallet-friendly LCCs are here to stay.


When Air Deccan introduced airfares almost equalling the AC II-tier train fares, the response from the leading domestic airlines like Indian Airlines, Jet Airways and Sahara Airlines was immediate. Slashed rates and Advanced Purchase schemes (Apex) swiftly began to take shape, resulting upto 30 to 40 per cent slashed fares compared with the original prices.


Barely a year after Air Deccan took off came the launch of Vijay Mallya's Kingfisher Airlines, followed by SpiceJet and GoAir. Today the number of LCC's has multiplied from three to a dozen in a matter of months. Since the entry barriers are low, players such as Paramount, IndiGO (Interglobe), Yamuna Air or Kerala Airways, have already filed flight plans.


Continuing a steady progress, LCC's are slowly eating into the aviation market share, capturing almost one third of the total market.


However the dip in market share does not necessarily mean a drop in the number of passengers or revenues for the mainstream airlines, as the size of the air travel segment has also been increasing. In the market driven by the LCCs- with about half of the passengers being first-time air travellers, there's a bigger pie for everyone.


But the biggest loser so far has been Indian Airlines. Even with its trendy make over called Indian, it has been left with a market share of only 23.88 per cent while the potential Jet-Sahara combine controls 45 per cent.


As a result it is now exploring the possibility of floating a subsidiary for low-cost operations by merging Air-India Express, the low-fare arm of A-I with Alliance Air, the decade-old wholly-owned subsidiary of IA servicing tier II cities. This could mean that India would have its first-ever LCC, having both domestic and international operations.


However this fairy tale of low cost airline advent is still in its initial stages.


In Europe, North America and Australasia, most successful low cost airlines have operated primarily in domestic, or unrestricted international markets. The LCCs in India on the other hand, have to operate in a highly regulated domestic environment. This is likely to get compounded with the surge in aviation fuel prices over the past year and the plummeting infrastructure with congestion in airports, lack of landing facilities and parking slots, and increasing staff costs driven by internal competition.


These non-frill LCCs are characterised by few on-board services and elimination of catering. But for the Indian travellers accustomed to travelling in the crowded trains for long hours, the aggressive tariff structure by the LCCs, costing nominally higher than the AC II-tier by train, is becoming a popular alternative.


With the LCCs now targeting the middle-class travellers, the Indian skies are slowly but surely opening up to the one billion plus Indian population.

ELDER ABUSE IN INDIA: TIME TO KNOW WHAT IT IS?


INTRODUCTION
Broadly defined, elder abuse10 covers any behaviour or pattern of behaviour by a
person or persons which results in harm to an older person11. Little consensus exists
on the range of harms which this broad definition should include. Definitional
categories are often diverse, including combinations of physical abuse, psychological
abuse, medical abuse, economic abuse, violations of rights, sexual abuse, neglect and
self-neglect. These categories are often further modified by distinctions between
intentional and unintentional acts, or passive or active abuse (acts and omissions);
those which focus on the trust and obligation of care or on the relationship between
the abused and the perpetrator; or which focus on the harm caused, regardless of
the intention of the abuser.
WHY DOES ELDER ABUSE OCCUR?
Elder abuse is also very often the result of long-term family conflict between parent
and child or between spouses. Increasingly, the relationship between domestic
violence and elder abuse is understood to be important. In the few studies which
examine the phenomenon as a specific category, domestic violence accounts for a
significant percentage of cases identified as "elder abuse". In many of these cases,
the abuse is the continuance of long-term domestic violence into old age. With the
onset of disability and the intervention of community services, behaviour which has
long been carefully concealed is exposed and labelled as "elder abuse". However,
once again, the relationship is not straightforward. In some cases, the situation is
reversed--the long-term perpetrator becomes dependent upon their victim and the
domestic violence victim now becomes the abuser under changed power relations.
As well as domestic violence, a history of other forms of family violence such as child
abuse plays an important role. An abusive carer may also be the victim of domestic
violence or the adult survivor of child abuse who is now in a position of power over
their past perpetrator.
A full understanding of elder abuse must also move beyond individual risk factors,
and concentrate upon the problem as a function of broader social structural issues
such as poverty, isolation, ethnicity and gender.
INFORMAL
As with other social problems, the ideal prevention strategy is to effect long-term
change in community attitudes which directly or indirectly sanction such behaviour.
Raising community awareness and creating a widespread intolerance to the
behaviour can be encouraged through a "social capital" approach--fostering social
bonds, social trust and mutual reciprocity. This perspective emphasises a "bottomup"
model--from self and community education/resolution, through increased
support services and ultimately to a
"last resort" legal intervention. Community education, initiatives which reduce
isolation of older people in their communities, the encouragement of the view that
elder abuse is a mainstream issue on a par with other forms of family violence, and
campaigns which emphasise more positive images of older people can all assist with
developing a broad based, active community intolerance to elder abuse. However
ideal such an approach, though, more immediate and formal responses are also
necessary.
FORMAL RESPONSES AND THE ROLE OF LEGAL INTERVENTIONS
Instances of elder abuse very often first come to the attention of health and geriatric
services and are mainly the responsibility of Aged Care Assessment Teams
(ACATs). Thus, the major emphasisin response tends to be located firmly within a
"care" model rather than a "violence" or criminal justice model12. This is in
contrast to the United States, where many states have statutes targeted specifically
to elder abuse as a discrete category many including the use of mandatory
reporting. In response to many criticisms and difficulties with this system13.
AUSTRALIA
Australia has adopted a more cautionary approach. Other than guardianship
legislation and disability acts in various Australian States, to protect the decision
impaired older person, no Australian legislation specifically deals with the abuse of
the elderly. Legal options are available within the existing criminal justice
framework: reporting directly to the police to be dealt with as crimes or obtaining
an Apprehended Violence Order (AVO) where there is immediate danger or threat
of danger. This absence of specific legislation in Australia is not an oversight, but
the result of considerable community consultation on the part of various
government inquiries and working groups. They have particularly recommended
caution in relation to mandatory reporting. Results from this strategy overseas have
been mixed; not enough is known to justify such an intrusive response, and one
which requires substantial resourcing. Also, there are ethical difficulties where a
victim is a competent adult. As an alternative, Australia has preferred to develop
protocols and guidelines that emphasise a multi-disciplinary approach and effective
cooperation between health services.
THE PROBLEM OF ELDER ABUSE IN INDIA
"An eighty four year old women living with her son and daughter- inlaw.
She was ill treated by her family members putting her in the corridor of the
house and she cannot go anywhere just like prisoner she was treated and also she
was forced to do all the work of the house. The cruel part of the story is that her
daughter-in-law was forcing her to bath by the toilet water14".
The existing research on elder abuse in Indian country is sparse and limited in
scope. A review of the literature conducted as part of this project15revealed that only
three of the 567 federally recognized tribes in the United States and one urban
population have been the subject of research studies. Even among these groups,
significant differences have been noted16. Establishing the extent and nature of
abuse in Indian country was beyond, however, several project activities provided
opportunities to explore participants' experiences with, and perceptions about,
abuse17.
EXAMPLES OF KEY INFORMANTS ELDER ABUSE IN INDIA
* An elderly woman was removed from a nursing home so that family
members could gain access to her income checks.
* Family members set up a methamphetamine lab in an elder's home.
* A non-ambulatory elder was left without water or food and was not taken to
her dialysis appointments.
* A son and daughter-in-law overmedicated a wealthy older woman in order
to hasten her death.
* An elder was taken off dialysis and had her medications withheld as
"punishment."
* A woman was "beaten black and blue" and sexually molested by her
children.
* An elderly woman's home was taken over by younger people on the
reservation who are alcoholic. They financially abused the woman and
placed her in a nursing home.
* An elderly woman allowed her nephew and his family to move into her
home. The nephew got his aunt to sign a quitclaim deed, transferring
ownership of the property to him. She did not understand what she was
signing and did not want to give up her home.
* An elder signed over her paid-off Mutual Help home to her grandson,
expecting that she would be allowed to continue living there until she died.
The grandson subsequently evicted her.
* An 85-year-old woman reported to a domestic violence program that her son
had raped her.
An elderly woman reported to her physician, whom she had known for many
years that she had been the victim of domestic violence for 15 years.
WORLD HEALTH ORGANIZATION WORKING ON ELDER ABUSE
Elder abuse, the mistreatment of older people, is now achieving due
attention. However, prevalence studies concerning this type of abuse have so far
been restricted to developed nations, resulting in a dearth of evidence about the
prevalence of abuse, neglect, and financial exploitation of elders in developing
nations. In response to this problem, the World Health Organization (WHO) has
worked to develop a global strategy for the prevention of elder abuse, beginning
by conducting a study in eight countries (Argentina, Austria, Brazil, Canada,
India, Kenya, Lebanon, and Sweden)18.
Finally, implications of the study and strategies for the prevention of elder
abuse are presented. Strategies proposed by the focus group participants. For
example, recommendations for actions include:
* Development of a screening and assessment tool for use in primary health
care settings
* Development of an education package on elder abuse for primary health
care professionals
* Development and dissemination of a research methodology 'kit' to study
elder abuse
* Development of a Minimum Data Set concerning violence and older
people
* Dissemination of the research findings through scientific journals
* Development of a global inventory of good practice.
* Mobilisation of civil society through raising awareness of the widespread
magnitude of elder abuse.
TYPES OF ELDER ABUSE
* Physical abuse - the infliction of pain or injury, physical coercion, or physical
or drug induced restraint.
* Psychological or emotional abuse - the infliction of mental agony.
* Financial or material abuse - the illegal or improper exploitation or use of
funds or resources of the older person.
* Sexual abuse - non-consensual sexual contact of any kind with the older
person.
* Neglect - the refusal or failure to fulfil accrediting obligation.
This may or may not involve a conscious and intentional attempt to inflict physical
or emotional distress on the older person.
TRADITIONAL SOCIETIES AND THERE PRACTISES
Many traditional societies of the past considered family harmony to be an important
factor governing family relationships. This reverence for the family was reinforced
by philosophical traditions and public policy.
In Chinese society, it was embedded in a value system that stressed ''filial piety''.
Mistreatment of older people was unrecognized and certainly unreported. These
traditions are still influential today.
Studies in the United States of attitudes towards elder abuse revealed that citizens of
Korean origin believed in the primacy of family harmony over individual well-being
as a yardstick for determining whether a particular behaviour was regarded as
abusive or not19 Similarly, people of Japanese origin considered the "group" to be
paramount, and that an individual's well-being should be sacrificed for the good of
the group20 .
In some traditional societies, older widows are abandoned and their property
seized. Mourning rites of passage for widows in parts of Africa and India include
practices that elsewhere would certainly be considered cruel, for example sexual
violence, forced levirate marriages21 and expulsion from their homes22. In some
places, accusations of witchcraft, often connected with unexplained events in the
local community, such as a death or crop failure, are directed at isolated, older
women23.
In sub- Saharan Africa, accusations of the practice of witchcraft have driven many
older women from their homes and their communities to live in poverty in urban
areas. In the United Republic of Tanzania, an estimated 500 older women accused of
witchcraft are murdered every year24. These acts of violence have become firmly
entrenched as social customs and may not be considered locally as "elder abuse".
WHAT ARE THE RISK FACTORS FOR ELDER ABUSE?
Most of the early work on abuse of the elderly was limited to domestic settings and
carried out in developed countries. In seeking explanations for elder abuse,
researchers drew from the literature in the fields of psychology, sociology,
gerontology and the study of family violence. To accommodate the complexity of
elder abuse and the many factors associated with it, researchers have turned to the
ecological model, which was first applied to the study of child abuse and neglect25
and has been applied more recently to elder abuse2627. The ecological model can take
into account the interactions that take place across a number of systems28.
THE CONSEQUENCES OF ELDER ABUSE
For older people, the consequences of abuse can be especially serious. Older people
are physically weaker and more vulnerable than younger adults, their bones are
more brittle and convalescence takes longer. Even a relatively minor injury can
cause serious and permanent damage. Many older people survive on limited
incomes, so that the loss of even a small sum of money can have a significant impact.
They may be isolated, lonely or troubled by illness, in which case they are more
vulnerable as targets for fraudulent schemes.
CONCLUSION
The problem of elder abuse cannot be properly solved if the essential needs of older
people for food, shelter, security and access to health care are not met. The nations
of the world must create an environment in which ageing is accepted as a natural
part of the life cycle, where anti-ageing attitudes are discouraged, where older
people are given the right to live in dignity, free of abuse and exploitation, and are
given opportunities to participate fully in educational, cultural, spiritual and
economic activities .

ELDER ABUSE IN INDIA: TIME TO KNOW WHAT IT IS?


INTRODUCTION
Broadly defined, elder abuse10 covers any behaviour or pattern of behaviour by a
person or persons which results in harm to an older person11. Little consensus exists
on the range of harms which this broad definition should include. Definitional
categories are often diverse, including combinations of physical abuse, psychological
abuse, medical abuse, economic abuse, violations of rights, sexual abuse, neglect and
self-neglect. These categories are often further modified by distinctions between
intentional and unintentional acts, or passive or active abuse (acts and omissions);
those which focus on the trust and obligation of care or on the relationship between
the abused and the perpetrator; or which focus on the harm caused, regardless of
the intention of the abuser.
WHY DOES ELDER ABUSE OCCUR?
Elder abuse is also very often the result of long-term family conflict between parent
and child or between spouses. Increasingly, the relationship between domestic
violence and elder abuse is understood to be important. In the few studies which
examine the phenomenon as a specific category, domestic violence accounts for a
significant percentage of cases identified as "elder abuse". In many of these cases,
the abuse is the continuance of long-term domestic violence into old age. With the
onset of disability and the intervention of community services, behaviour which has
long been carefully concealed is exposed and labelled as "elder abuse". However,
once again, the relationship is not straightforward. In some cases, the situation is
reversed--the long-term perpetrator becomes dependent upon their victim and the
domestic violence victim now becomes the abuser under changed power relations.
As well as domestic violence, a history of other forms of family violence such as child
abuse plays an important role. An abusive carer may also be the victim of domestic
violence or the adult survivor of child abuse who is now in a position of power over
their past perpetrator.
A full understanding of elder abuse must also move beyond individual risk factors,
and concentrate upon the problem as a function of broader social structural issues
such as poverty, isolation, ethnicity and gender.
INFORMAL
As with other social problems, the ideal prevention strategy is to effect long-term
change in community attitudes which directly or indirectly sanction such behaviour.
Raising community awareness and creating a widespread intolerance to the
behaviour can be encouraged through a "social capital" approach--fostering social
bonds, social trust and mutual reciprocity. This perspective emphasises a "bottomup"
model--from self and community education/resolution, through increased
support services and ultimately to a
"last resort" legal intervention. Community education, initiatives which reduce
isolation of older people in their communities, the encouragement of the view that
elder abuse is a mainstream issue on a par with other forms of family violence, and
campaigns which emphasise more positive images of older people can all assist with
developing a broad based, active community intolerance to elder abuse. However
ideal such an approach, though, more immediate and formal responses are also
necessary.
FORMAL RESPONSES AND THE ROLE OF LEGAL INTERVENTIONS
Instances of elder abuse very often first come to the attention of health and geriatric
services and are mainly the responsibility of Aged Care Assessment Teams
(ACATs). Thus, the major emphasisin response tends to be located firmly within a
"care" model rather than a "violence" or criminal justice model12. This is in
contrast to the United States, where many states have statutes targeted specifically
to elder abuse as a discrete category many including the use of mandatory
reporting. In response to many criticisms and difficulties with this system13.
AUSTRALIA
Australia has adopted a more cautionary approach. Other than guardianship
legislation and disability acts in various Australian States, to protect the decision
impaired older person, no Australian legislation specifically deals with the abuse of
the elderly. Legal options are available within the existing criminal justice
framework: reporting directly to the police to be dealt with as crimes or obtaining
an Apprehended Violence Order (AVO) where there is immediate danger or threat
of danger. This absence of specific legislation in Australia is not an oversight, but
the result of considerable community consultation on the part of various
government inquiries and working groups. They have particularly recommended
caution in relation to mandatory reporting. Results from this strategy overseas have
been mixed; not enough is known to justify such an intrusive response, and one
which requires substantial resourcing. Also, there are ethical difficulties where a
victim is a competent adult. As an alternative, Australia has preferred to develop
protocols and guidelines that emphasise a multi-disciplinary approach and effective
cooperation between health services.
THE PROBLEM OF ELDER ABUSE IN INDIA
"An eighty four year old women living with her son and daughter- inlaw.
She was ill treated by her family members putting her in the corridor of the
house and she cannot go anywhere just like prisoner she was treated and also she
was forced to do all the work of the house. The cruel part of the story is that her
daughter-in-law was forcing her to bath by the toilet water14".
The existing research on elder abuse in Indian country is sparse and limited in
scope. A review of the literature conducted as part of this project15revealed that only
three of the 567 federally recognized tribes in the United States and one urban
population have been the subject of research studies. Even among these groups,
significant differences have been noted16. Establishing the extent and nature of
abuse in Indian country was beyond, however, several project activities provided
opportunities to explore participants' experiences with, and perceptions about,
abuse17.
EXAMPLES OF KEY INFORMANTS ELDER ABUSE IN INDIA
* An elderly woman was removed from a nursing home so that family
members could gain access to her income checks.
* Family members set up a methamphetamine lab in an elder's home.
* A non-ambulatory elder was left without water or food and was not taken to
her dialysis appointments.
* A son and daughter-in-law overmedicated a wealthy older woman in order
to hasten her death.
* An elder was taken off dialysis and had her medications withheld as
"punishment."
* A woman was "beaten black and blue" and sexually molested by her
children.
* An elderly woman's home was taken over by younger people on the
reservation who are alcoholic. They financially abused the woman and
placed her in a nursing home.
* An elderly woman allowed her nephew and his family to move into her
home. The nephew got his aunt to sign a quitclaim deed, transferring
ownership of the property to him. She did not understand what she was
signing and did not want to give up her home.
* An elder signed over her paid-off Mutual Help home to her grandson,
expecting that she would be allowed to continue living there until she died.
The grandson subsequently evicted her.
* An 85-year-old woman reported to a domestic violence program that her son
had raped her.
An elderly woman reported to her physician, whom she had known for many
years that she had been the victim of domestic violence for 15 years.
WORLD HEALTH ORGANIZATION WORKING ON ELDER ABUSE
Elder abuse, the mistreatment of older people, is now achieving due
attention. However, prevalence studies concerning this type of abuse have so far
been restricted to developed nations, resulting in a dearth of evidence about the
prevalence of abuse, neglect, and financial exploitation of elders in developing
nations. In response to this problem, the World Health Organization (WHO) has
worked to develop a global strategy for the prevention of elder abuse, beginning
by conducting a study in eight countries (Argentina, Austria, Brazil, Canada,
India, Kenya, Lebanon, and Sweden)18.
Finally, implications of the study and strategies for the prevention of elder
abuse are presented. Strategies proposed by the focus group participants. For
example, recommendations for actions include:
* Development of a screening and assessment tool for use in primary health
care settings
* Development of an education package on elder abuse for primary health
care professionals
* Development and dissemination of a research methodology 'kit' to study
elder abuse
* Development of a Minimum Data Set concerning violence and older
people
* Dissemination of the research findings through scientific journals
* Development of a global inventory of good practice.
* Mobilisation of civil society through raising awareness of the widespread
magnitude of elder abuse.
TYPES OF ELDER ABUSE
* Physical abuse - the infliction of pain or injury, physical coercion, or physical
or drug induced restraint.
* Psychological or emotional abuse - the infliction of mental agony.
* Financial or material abuse - the illegal or improper exploitation or use of
funds or resources of the older person.
* Sexual abuse - non-consensual sexual contact of any kind with the older
person.
* Neglect - the refusal or failure to fulfil accrediting obligation.
This may or may not involve a conscious and intentional attempt to inflict physical
or emotional distress on the older person.
TRADITIONAL SOCIETIES AND THERE PRACTISES
Many traditional societies of the past considered family harmony to be an important
factor governing family relationships. This reverence for the family was reinforced
by philosophical traditions and public policy.
In Chinese society, it was embedded in a value system that stressed ''filial piety''.
Mistreatment of older people was unrecognized and certainly unreported. These
traditions are still influential today.
Studies in the United States of attitudes towards elder abuse revealed that citizens of
Korean origin believed in the primacy of family harmony over individual well-being
as a yardstick for determining whether a particular behaviour was regarded as
abusive or not19 Similarly, people of Japanese origin considered the "group" to be
paramount, and that an individual's well-being should be sacrificed for the good of
the group20 .
In some traditional societies, older widows are abandoned and their property
seized. Mourning rites of passage for widows in parts of Africa and India include
practices that elsewhere would certainly be considered cruel, for example sexual
violence, forced levirate marriages21 and expulsion from their homes22. In some
places, accusations of witchcraft, often connected with unexplained events in the
local community, such as a death or crop failure, are directed at isolated, older
women23.
In sub- Saharan Africa, accusations of the practice of witchcraft have driven many
older women from their homes and their communities to live in poverty in urban
areas. In the United Republic of Tanzania, an estimated 500 older women accused of
witchcraft are murdered every year24. These acts of violence have become firmly
entrenched as social customs and may not be considered locally as "elder abuse".
WHAT ARE THE RISK FACTORS FOR ELDER ABUSE?
Most of the early work on abuse of the elderly was limited to domestic settings and
carried out in developed countries. In seeking explanations for elder abuse,
researchers drew from the literature in the fields of psychology, sociology,
gerontology and the study of family violence. To accommodate the complexity of
elder abuse and the many factors associated with it, researchers have turned to the
ecological model, which was first applied to the study of child abuse and neglect25
and has been applied more recently to elder abuse2627. The ecological model can take
into account the interactions that take place across a number of systems28.
THE CONSEQUENCES OF ELDER ABUSE
For older people, the consequences of abuse can be especially serious. Older people
are physically weaker and more vulnerable than younger adults, their bones are
more brittle and convalescence takes longer. Even a relatively minor injury can
cause serious and permanent damage. Many older people survive on limited
incomes, so that the loss of even a small sum of money can have a significant impact.
They may be isolated, lonely or troubled by illness, in which case they are more
vulnerable as targets for fraudulent schemes.
CONCLUSION
The problem of elder abuse cannot be properly solved if the essential needs of older
people for food, shelter, security and access to health care are not met. The nations
of the world must create an environment in which ageing is accepted as a natural
part of the life cycle, where anti-ageing attitudes are discouraged, where older
people are given the right to live in dignity, free of abuse and exploitation, and are
given opportunities to participate fully in educational, cultural, spiritual and
economic activities .

Prior to 1980s, only the aggrieved party could personally knock the doors of justice and seek remedy for his grievance and any other person who was not personally affected could not do so as a proxy for the victim or the aggrieved party. But around 1980, the Indian legal system, particularly the field of environmental law, underwent a sea change in terms of discarding its moribund approach and instead, charting out new horizons of social justice. This period was characterized by not only administrative and legislative activism but also judicial activism.

In a modern welfare state, justice has to address social realities and meet the demands of time. Protection of the environment throws up a host of problems for a developing nation like ours. Administrative and legislative strategies of harmonization of environmental values with developmental values are a must and are to be formulated in the crucible of prevalent socio-economic conditions in the country. In determining the scope of the powers and functions of administrative agencies and in striking a balance between the environment and development, the courts have a crucial role to play. Principle 10 of the Rio Declaration of 1992 specifically provides for effective access to judicial and administrative proceedings, including redress and remedy.

The judiciarys anxiety for combating environmental assaults has already been well elucidated. Its concern for the maintenance and preservation of forests, one of our depleting natural resources has also been highlighted.

Public Interest Litigation (PIL) has come to stay in India. "Public Interest Litigation means a legal action initiated in a court of law for the enforcement of public interest or general interest in which the public or class of the community have pecuniary interest or some interest by which their legal rights or liabilities are affected."[1]

Contrary to the past practices, today a person acting bona fide and having sufficient interest can move the courts for redressing public enquiry, enforcing public duty, protecting social and collective rights and interests and vindicating public interest. In course of time there has been a wave of environmental litigation.

At present most environmental actions in India are brought under Articles 32 and 226 of the Constitution. The writ procedure is preferred over the conventional suit because it is speedy, relatively inexpensive and offers direct access to the highest courts of the land. Nevertheless, class action suits also have their own advantages. The powers of the Supreme Court to issue directions under Article 32 and that of the high courts under Article 226 have attained greater significance in environmental litigation. Courts have made use of these powers to remedy past malafides and to check immediate and future assaults on the environment.

The formulation of certain principles to develop a better regime for protecting the environment is a remarkable achievement. In the Bhopal Gas case,[2] the Supreme Court formulated the doctrine of absolute liability for harm caused by hazardous and inherently dangerous industries by interpreting the scope of the power under Article 32 to issue directions or orders which ever may be appropriate in appropriate proceedings. According to the Court, this power could be utilized for forging new remedies and fashioning new strategies.

These directions were given by courts for disciplining the developmental processes, keeping in view the demands of ecological security and integrity. In one of the earlier cases, Rural Litigation Kendra,[3] that posed an environment development dilemma, Supreme Court gave directions that were necessary to avert an ecological imbalance, such as constitution of expert committees to study and to suggest solutions, establishment of a monitoring committee to oversee afforestation programmes and stoppage of mining operations that had an adverse impact on the ecology.

The rights to livelihood and clean environment are of grave concern to the courts whenever they issue a direction in an environmental case. In CERCs case,[4]Labourers engaged in the asbestos industry were declared to be entitled to medical benefits and compensation for health hazards, which were detected after retirement. Whenever industries are closed or relocated, labourers losing their jobs and people who are thereby dislocated were directed to be properly rehabilitated. The traditional rights of tribal people and fisherman are not neglected when court issue directions for protection of flora and fauna near sanctuaries or for management of coastal zones.[5]

In L.K.Koolwal v. State of Rajasthan,[6] the Rajasthan High Court observed that a citizens duty to protect to protect the environment under Article. 51-A(g) of the Constitution bestows upon the citizens the right to clean environment.   

The judiciary may go to the extent of asking the government to constitute national and state regulatory boards or environmental courts. In most cases, courts[7] have issued directions to remind statutory authorities of their responsibility to protect the environment. Thus, directions were given to local bodies, especially municipal authorities, to remove garbage and waste and clean towns and cities.[8]

In Indian Council for Environ-legal Action v. Union of India,[9] Supreme Court felt that such conditions in different parts of the country being better known to them, the high courts would be the appropriate forum to be moved for more effective implementation and monitoring of the anti-pollution law.

The liberal use of PIL against assaults on the environment does not mean that the courts, even if it is tainted with bias, ill will or intent to black mailing will entertain every allegation. This amounts to vexatious and frivolous litigation. When the primary purpose for filing a PIL is not public interest, courts will not interfere. In Subhash Kumar v. State of Bihar,[10] the Supreme Court upheld that affected persons or even a group of social workers or journalists, but not at the instance of a person or persons who had a bias or personal grudge or enmity could initiate PIL for environmental rights.

The apex court in landmark judgement of S.P.Gupta v. Union of India,[11] elucidated in the following words:

but we must hasten to make it clear that the individual who moves to court for judicial redress in cases of this kind must be acting bona fide with a view to vindicating the cause of justice and if he is acting for personal gain or private profit or out of political motivation or other oblique consideration, the court should not allow itself to be activised at the instance of such person and must reject his application at the threshold  

The right to humane and healthy environment is seen indirectly approved in the MC Mehta group of cases, decided subsequently by the Supreme Court.

The first MC Mehta case[12] enlarged the scope of the right to live and said that the state had power to restrict hazardous industrial activities for the purpose of protecting the right of the people to live in a healthy environment. Although the second MC Mehta case [13]modified some of the conditions, the third MC Mehta case[14] posed an important question concerning the amount of compensation payable to the victims affected by the leakage of oleum gas from the factory. The Court held that it could entertain a petition under Article 32 of the Constitution and lay down the principles on which the quantum of compensation could be computed and paid. This case is significant as it evolved a new jurisprudence of liability to the victims of pollution caused by an industry engaged in hazardous and inherently dangerous activities. The fourth MC Mehta case [15]was regarding the tanning industries located on the banks of Ganga was alleged to be polluting the river. The Court issued directions to them to set up effluent plants within six months from the date of the order. It was specified that failure to do so would entail closure of business.

The four MC Mehta cases came before the Supreme Court under Article 32 of the constitution on the initiative of the public-spirited lawyer. He filed the petitions on the behalf of the people who were affected or likely to be affected by some action or inaction. The petitioner had no direct interest in the subject and had suffered no personal injury. Still standing to sue was not raised at the threshold question to be decided by the Court.

The Supreme Court has further expanded Right to life in recent years. In Consumer Education and Research Centre v. Union of India,[16] the Court said,

Social security, just and humane conditions of work and leisure to workmen are as a part of his meaningful right to life

The court held that this fundamental right to health and medical aid should continue even after retirement. Significantly, the Court said that in appropriate cases, appropriate directions could be issued to the state or private employer with a view to protecting the environment, preventing pollution in the workplace safeguarding the health of the workmen or preserving free and unpolluted water for safety and health of the people. Directions were issued to the asbestos industry, and the union and state authorities are meant to fill up the yawning gaps in the interpretation of the law.

The concept of compensation for environmental degradation has evolved at a snails pace over a period. It started with the strict liability principle followed by the absolute liability principle and then compensation under Article 32 and finally the polluter pays principle.

The polluter pays principle means two things:

1. The polluter should pay for the administration of the pollution control system;

2. The polluter should pay for the consequences of the pollution  

This concept was further elaborated in the Vellore Tanneries Pollution case,[17] as follows:

The Pollluter Pays Principle as interpreted by this court means that the absolute liability for harm to the environment extends not only to compensate the victims of pollution but also the cost of restoring the environmental degradation. Remediation of the damaged environment is part of the process of Sustainable Development and as such the polluter is liable to pay the cost to the individual sufferers as well as the cost to the individual sufferers as well as the cost for reversing the damaged ecology.  

The society shall have to prosper, but not at the cost of the environment and in the similar vein, the environment shall have to be protected but not at the cost of development of the society. The need of the hour is to strike a balance between the two i.e., development on one side and pollution free environment on the other. A process by which development can be sustained for generations by improving the quality of human life while at the same time living in harmony with nature and maintaining the carrying capacity of life supporting eco-system. It focuses at integration of developmental and environmental imperatives. Thus, sustainable development is the only answer and administrative actions ought to proceed in accordance therewith and not dhors the same.

Custom Motorcycle Builders Trevelen VS Indian Larry Legacy


We got to see an amazing build-off last night. Trevelen, Kieno, Paul Cox and their crews were magnificent!! The craftsmanship and customization of these motorcycles was second to none. Hugh King has done a great job showing us more of the build and less extraneous filler. The two episodes this year have made me feel like I was right there. The fabrication and workmanship were featured and the ?fluff? was absent. I have learned more from these first two build-offs than most before them. I believe the reason for this is that the focus of the show has changed.

Trevelen built an incredible motorcycle. He built it out of copper, silver, iron and nickel. I love when someone builds a motorcycle from copper. The look is rich and classy. Trevelen used a springer front end. He based the bike on the old Indian. He used an 84 cu inch flathead engine. The copper fender was hand finished. I loved the copper bike the great Jesse James built for Motorcycle Mania 3 and I loved the look of this bike as well. Trevelen had some problems with the paint and the wrong size sprocket. The sprocket problem almost ruined him but, they were able to fix it.

Paul Cox and Kieno also built a masterpiece. Keino built a unique panhead, knucklehead power plant. It was really creative and a testimonial to his skill. They decided to make an aluminum gas tank and employ a girder front end. They had the help of John Mack, master machinist. There were a lot of custom parts fabricated. It was amazing that they could build this bike in 10 days.

A friend of theirs flew in from Japan with hand made pushrod covers which were beautiful. He then proceeded to fabricate a hand made jockey shift nob which was very cool. There was a lot of etching done and this was indeed a work of art. Legacy seems to build their bikes in the tradition of their namesake. No one of course can be Larry but Paul and Keino were Larry?s key guys and they haven?t dropped the ball. This was a beautiful blue machine.

The guys met out in the desert to begin their ride. I have one problem with what happened. I think it?s great that these men who toil over their work also maintain class that permeates the real biker world. Trevelen ran into trouble on the ride and could not continue. He had to take it in for repairs or he was done. Paul and Keino had the right to disqualify him but, of course, they did not. I love the brotherhood they displayed. It makes me proud. The rules state however, that you have a few tools you carry and if you can?t fix a problem with those tools, you lose!! I realize that what Keino and Paul did is good for the show and what all brothers would do but, why have rules if they don?t mean anything? They actually changed the rules last year to just a few tools to enhance the integrity of the show.

The show is also sharing more about the builders as people. I think that?s a very positive change. We got to learn about Trevelen?s rocky past and we got to meet Paul?s wife and baby. We try and do that here with our podcast interviews. These are not just magnificent artists, they are people with lives and a story.

As I said, this was another great show. Trevelen built a great motorcycle and so did Paul and Keino. There was no winner, no loser. They should have given them both trophy?s for their work. Do you remember when Billy and Larry did just that? They cut the trophy in half.

Indian Food as Part of a Weight Loss Regime



Most people think that you can't possibly eat Indian food, if you're on a slimming diet. That's a fair statement if you always eat Indian food in restaurants, because many traditional Indian recipes involve either deep frying or the use of ghee (clarified butter). However, if you cook Indian food at home, it can easily form part of a weight loss regime, just the same as any other food. You just need to follow a few simple general rules.


- Avoid altogether recipes which involve deep frying.
- If you need to seal meat before braising it for a curry, use a good non-stick pan and a spray bottle with sunflower or vegetable oil in it. Lightly spray the surface of your pan with oil and that should be enough to prevent the meat from sticking while you brown it.
- If a recipe includes cream or coconut cream, substitute plain yoghurt and another flavouring to replace the coconut.


Tandoori recipes are great as part of a low calorie or low carbohydrate diet. Just marinade some fish (cubed or whole), chicken (cubed or in pieces) or prawns (shrimp) in a mixture of low fat plain yogurt, ground turmeric, ground coriander, ground cumin, crushed garlic, grated root ginger and a little chilli powder (or to taste) for at least an hour. If you're using cubed meat, thread onto skewers. Grill or barbeque with a medium heat until done. Serve with mixed salad and wedges of lemon to squeeze over. If your diet isn't too severe, you can also have a pitta bread, a baked potato or some boiled rice with this.


Curry dishes are fine too (preferably fish or chicken). If you use a recipe which has just a spice and water base or a tomato base, it certainly won't do your calorie intake any harm but be sure to keep the oil you use for frying onions, spices or whatever, to an absolute minimum.


For vegetarians or those trying to cut down on meat because of its relatively high calorie content, Indian cooking is ideal. There are so many recipes for vegetables and pulses which are really tasty that you won't even know you're on a diet!


Don't forget paneer (Indian cottage cheese), which can be cooked as per the tandoori idea above, or in a spicy sauce. If you can't get paneer, try substituting tofu.
